Terms of Service

1. Acceptance of Terms

Welcome to Bisou Match. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Bisou Match Inc. (“Bisou,” “we,” “us,” or “our”) governing your access to and use of our platform, applications, and services (collectively, the “Service”). By registering for an account, accessing the Service, or otherwise indicating your acceptance, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you may not access or use the Service.

1.1 Related Policies

These Terms incorporate by reference and must be read together with the following additional policies, each of which forms part of the agreement between you and Bisou:

• Privacy Policy — This policy describes how Bisou collects, uses, discloses, and protects your personal information in connection with the Service.
• Child Safety Policy — This policy sets out Bisou's commitment to protecting minors and prohibiting the use of the Service by or in connection with individuals under the age of majority.
• Community Guidelines — These guidelines establish the standards of conduct expected of all users and supplement the user conduct provisions of these Terms.

In the event of any conflict between these Terms and any incorporated policy, these Terms shall govern unless the relevant policy expressly states otherwise.

1.2 Eligibility

To access or use the Service, you must satisfy all of the following eligibility requirements. You must be at least eighteen (18) years of age, or nineteen (19) years of age if you reside in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, or Yukon. You must have the legal capacity to enter into binding contracts under the laws of your jurisdiction. You must not be prohibited from receiving or using the Service under any applicable law. You must comply with all laws and regulations applicable to your use of the Service. By accessing the Service, you represent and warrant that you meet all of these eligibility requirements. If you are accessing the Service on behalf of a company or other legal entity, you further represent that you have the authority to bind that entity to these Terms.

2. Account Registration

2.1 Account Creation

To access the features of the Service, you must register and create an account. In doing so, you agree to provide accurate, current, and complete information, including your real name, age, a valid email address, and valid birth data (including date, time, and place of birth) necessary for Vedic astrology calculations. You are responsible for maintaining the accuracy of your account information and must update it promptly whenever it changes.

You further agree to keep your password and account credentials confidential, to notify us immediately at support@bisoumatch.com if you suspect any unauthorized access to or use of your account, and not to share your account or credentials with any other person. You are solely responsible for all activity that occurs under your account, whether or not authorized by you.

2.2 Account Verification

Bisou reserves the right, at its sole discretion, to verify any information you provide in connection with your account, including your age and identity, the authenticity of your photographs, and the accuracy of your birth information. We may request additional documentation or information to complete verification. Failure to provide requested information or to pass verification may result in the suspension or termination of your account.

2.3 One Account Per Person

Each user is permitted to maintain only one active account on the Service. The creation of multiple accounts by a single individual is prohibited. If we determine that you have created or are operating more than one account, we reserve the right to terminate all associated accounts without notice or liability.

3. Our Service

3.1 Description of Service

Bisou Match is a social platform that uses Vedic astrology principles to suggest potentially compatible matches between users. The Service enables you to create a profile, view other users' profiles, receive astrological compatibility insights, communicate with your matches, and access enhanced features through paid subscription plans. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

3.2 Vedic Astrology — Important Disclaimers

Bisou uses Vedic astrology solely as a framework for suggesting potentially interesting connections between users. All astrological compatibility assessments and related content provided through the Service are intended for entertainment purposes only. Bisou does not represent that astrology is a science or that any compatibility assessment is accurate, reliable, or predictive of any real-world outcome. The accuracy of birth chart calculations is entirely dependent on the accuracy of the birth information you provide, and different astrological systems or interpretations may produce different results. Astrological content should not be relied upon in making any significant life decision, and Bisou expressly disclaims any responsibility for decisions made in reliance on such content.

3.3 No Guarantee of Relationship Outcomes

Bisou provides a platform to facilitate introductions and communication between users. We make no representation or warranty that use of the Service will result in any particular outcome, including that you will find a romantic match, that any match will be compatible with you, or that any relationship will be successful. Except where required by applicable law, Bisou does not conduct criminal background checks or otherwise independently verify user-provided information, though we may employ technical and procedural measures to detect and prevent fraudulent or harmful conduct. You are solely responsible for exercising judgment and taking appropriate precautions in all interactions with other users, including in-person meetings.

4. User Conduct

4.1 Prohibited Activities

By using the Service, you agree not to engage in any of the following prohibited activities. With respect to interactions with other users, you may not contact, solicit, or interact with any person you know or have reason to believe is a minor; harass, threaten, stalk, intimidate, or otherwise engage in abusive behavior toward any person; or disclose another person's private or personally identifiable information without that person's explicit consent.

With respect to your account and profile, you may not provide false or misleading information, including misrepresenting your age or identity; use photographs that do not depict you or that misrepresent your appearance; impersonate any person or entity; or create duplicate, fake, or spam accounts.

With respect to the platform and its technical integrity, you may not scrape, crawl, or otherwise extract data from the Service through automated means; attempt to reverse engineer, decompile, or otherwise access the source code or underlying architecture of the Service; introduce any malware, virus, or other malicious code; or interfere with or disrupt the operation of the Service or the servers and networks supporting it.

With respect to content and commerce, you may not post, transmit, or otherwise make available any content that is sexually explicit, violently graphic, or promotes hatred or discrimination; upload or share any child sexual abuse material (CSAM) or any content that exploits or sexualizes minors; infringe the intellectual property rights of Bisou or any third party; solicit money, financial information, or gifts from other users; promote or advertise any products or services other than through channels expressly authorized by Bisou; or engage in or facilitate prostitution, human trafficking, or any other illegal commercial activity.

4.2 Consequences of Violations

Bisou reserves the right to investigate any reported or suspected violation of these Terms and to take such action as we deem appropriate in our sole discretion. Depending on the nature and severity of the violation, consequences may include the issuance of a formal warning, the temporary suspension of your account, the permanent termination of your account and all associated data, the reporting of illegal activity to relevant law enforcement authorities, and the initiation of civil or criminal legal proceedings. Our exercise of any of these remedies does not waive our right to pursue additional remedies.

5. Content

5.1 Your Content and License Grant

You retain ownership of all content that you submit, post, or otherwise make available through the Service, including photographs, messages, and profile information (“Your Content”). By submitting Your Content, you grant Bisou a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform Your Content in connection with the operation, improvement, and marketing of the Service and in any media formats and through any media channels now known or hereafter developed.

This license continues for as long as Your Content remains on the Service. Upon your deletion of specific content or the termination of your account, the license with respect to that content will terminate, except to the extent that: (a) Your Content has been shared with other users, who may retain copies; (b) we are required to retain copies for legal, regulatory, or legitimate business purposes; or (c) Your Content has been anonymized or aggregated, in which case we may continue to use it indefinitely.

5.2 Prohibited Content

You may not post, upload, transmit, or otherwise make available through the Service any content that: violates any applicable law or regulation or the rights of any third party; is false, misleading, deceptive, or fraudulent; contains nudity, pornography, or sexually explicit material; promotes or incites violence, hatred, or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic; involves, exploits, or is directed at minors in an inappropriate manner; or infringes the copyright, trademark, trade secret, or other intellectual property rights of any person or entity.

5.3 Bisou's Proprietary Content

All content comprising or forming part of the Service — including but not limited to design elements, logos, trademarks, service marks, text, graphics, images, and software — is the property of Bisou Match Inc. or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Bisou's proprietary content other than as strictly necessary to use the Service for its intended purpose. You may not copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, or transfer or sell any proprietary content without our prior written consent.

6. Subscriptions and Payments

6.1 Free and Paid Tiers

Bisou offers a free tier that provides access to basic matching and a limited set of features, as well as one or more paid premium subscription plans that unlock enhanced features, including unlimited matches and advanced astrological insights. The features available within each tier are subject to change at Bisou's discretion.

6.2 Subscription Terms and Auto-Renewal

All premium subscriptions are offered on a recurring basis and will automatically renew at the end of each subscription period unless you cancel before the renewal date. Upon renewal, your payment method on file will be charged at the then-current subscription rate. It is your responsibility to cancel your subscription in advance of renewal if you do not wish to be charged. You may cancel your subscription at any time through your account settings.

All subscription fees are charged in advance of the applicable subscription period. Accepted payment methods include major credit and debit cards and in-app purchases through supported app store platforms. Fees are denominated and charged in the currency applicable to your billing region, which may include USD, CAD, EUR, or GBP.

6.3 Refund Policy

All subscription fees and other charges are non-refundable except where a refund is expressly required by applicable consumer protection law, where the Service has been unavailable for an extended period due to circumstances attributable to Bisou, or where a billing error has occurred. Cancellation of a subscription does not entitle you to a refund of any fees already charged; you will retain access to the premium features of the Service until the end of the then-current paid subscription period. No partial refunds are provided for any unused portion of a subscription period.

6.4 Price Changes

Bisou reserves the right to modify its subscription fees or introduce new fees for any aspect of the Service. We will provide you with no less than thirty (30) days' prior written notice of any material price change. Your continued use of the Service following the effective date of a price change constitutes your acceptance of the new pricing. If you do not accept the new pricing, you must cancel your subscription before the price change takes effect.

6.5 In-App Purchases

Where the Service is accessed through a third-party app store platform (such as the Apple App Store or Google Play), any purchases made through that platform are governed by the applicable app store's terms and conditions in addition to these Terms. Refund requests for app store purchases must be directed to the relevant app store operator, as Bisou does not have the ability to process refunds for transactions processed through third-party platforms.

7. Communication

7.1 Service-Related Communications

By creating an account, you agree to receive communications from Bisou that are necessary for the provision and administration of the Service. Such communications may include service-related notifications, account status updates, security alerts, notices of changes to these Terms or other applicable policies, and responses to customer support inquiries. These service-related communications are a condition of your use of the Service, and you may not opt out of receiving them while your account remains active.

7.2 Advertisements, Offers, and Events

In addition to service-related communications, Bisou Match may send you promotional communications, including advertisements, special offers, and invitations to participate in events. Such communications may be delivered by email, in-app notification, or push notification, and may include: special pricing and discount offers on Bisou Match premium subscription plans; seasonal promotions and platform feature announcements; curated third-party offers in categories relevant to our users, such as wellness, entertainment, and lifestyle; invitations to Bisou Match-hosted or co-sponsored events, including social gatherings, community meetups, astrological workshops, and virtual experiences; and in-app advertisements displayed during your use of the Service.

By creating an account, you acknowledge that you may receive promotional communications of the types described above. Where required by applicable law — including Canada's Anti-Spam Legislation (CASL) for Canadian residents and the General Data Protection Regulation (GDPR) for residents of the European Union or United Kingdom — Bisou will obtain your express consent prior to sending such communications. Bisou will not use SMS messaging for promotional purposes; all SMS communications from Bisou are limited to transactional messages, such as one-time password (OTP) verification codes.

You may withdraw your consent to receive promotional communications at any time by adjusting your notification preferences in your account settings or by following the unsubscribe instructions included in any promotional email. Opting out of promotional communications will not affect your right to receive service-related communications or your ability to access and use the core features of the Service.

Data Collection Through Promotional Activities. When you engage with a promotional communication or participate in an event hosted or co-sponsored by Bisou — including by clicking on an advertisement or offer, registering for an event, or completing a survey or feedback form — Bisou may collect personal information generated through that engagement, such as your responses, registration details, and interaction data. All personal information collected through promotional activities is treated in the same manner as other personal information collected by Bisou and is managed in accordance with our Privacy Policy, which is incorporated herein by reference.

7.3 User-to-User Communication

Messages exchanged between users through the Service's messaging features are intended to be private between the respective parties. However, you acknowledge that Bisou may access and review such communications where necessary to enforce these Terms, investigate reports of prohibited conduct, ensure platform safety, or comply with applicable law. Users who receive inappropriate messages are encouraged to report them using the reporting tools available within the Service, and Bisou reserves the right to take appropriate action, including account suspension or termination, in response to confirmed violations.

8. Intellectual Property

8.1 Trademarks

“Bisou Match,” the Bisou Match logo, and all related marks, names, and trade dress are the registered or unregistered trademarks of Bisou Match Inc. Nothing in these Terms or your use of the Service confers upon you any right to use Bisou's trademarks without our prior written consent. Any unauthorized use of Bisou's trademarks is strictly prohibited and may constitute an infringement of our intellectual property rights.

8.2 Copyright

The Service and all content made available by Bisou through the Service, including but not limited to text, graphics, user interface design, photographs, and software, are protected by copyright law and are the property of Bisou Match Inc. or its licensors. All rights not expressly granted under these Terms are reserved. To report suspected copyright infringement, please contact us at business@bisoumatch.com.

8.3 Copyright Infringement Claims (DMCA)

If you believe that content available through the Service infringes a copyright you own or control, you may submit a notice of claimed infringement to our designated agent at support@bisoumatch.com. Your notice must include: (a) a description of the copyrighted work you claim has been infringed; (b) identification of the specific content on the Service that you allege is infringing, with sufficient information to allow us to locate it; (c) your name, mailing address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use of the content is not authorized by the copyright owner, its agent, or applicable law; and (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. Upon receipt of a valid notice, Bisou will investigate and may remove or disable access to the allegedly infringing content pending resolution.

9. Disclaimers

9.1 Service Provided “As Is”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BISOU EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. BISOU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

9.2 Astrological Content Disclaimer

All Vedic astrological content, compatibility assessments, and related features provided through the Service are offered for entertainment purposes only. Such content does not constitute professional advice of any kind, including psychological, relationship, or life-planning advice, and is not scientifically validated. Bisou makes no representation as to the accuracy, reliability, or validity of any astrological content, and expressly disclaims any responsibility for decisions made by users in reliance on such content. Results may vary based on the astrological system applied and the interpretation methodology used.

9.3 User Interactions and Safety

Bisou is not responsible for the conduct of any user, whether online or offline. We do not endorse or verify the accuracy of any user profile, and the information displayed on user profiles reflects the representations of the users themselves, not Bisou. You acknowledge and agree that any interactions you have with other users — including, without limitation, any in-person meetings arranged through the Service — are entirely at your own risk. Bisou assumes no responsibility for any harm, loss, or damage arising out of your interactions with other users. You are encouraged to exercise caution and good judgment in all interactions facilitated by the Service.

9.4 Third-Party Services

The Service may integrate with or contain links to third-party websites, applications, or services, including payment processors and social media platforms. Bisou does not control and is not responsible for the content, privacy practices, or terms of any third-party service. Your use of any third-party service is governed solely by that service's own terms and policies. Bisou's inclusion of a link or integration does not constitute an endorsement of the third party or its services.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BISOU, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF BISOU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.2 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BISOU'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100 USD) OR (B) THE TOTAL AMOUNT PAID BY YOU TO BISOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

10.3 Jurisdictional Exceptions

Some jurisdictions do not permit the exclusion or limitation of certain categories of damages. To the extent that such laws apply to you, some or all of the exclusions and limitations set forth in this Section 10 may not apply, and your rights may be broader than those described herein. Nothing in these Terms limits Bisou's liability to the extent that such limitation is not permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bisou Match Inc. and its affiliates, directors, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or relating to: (a) your access to or use of the Service; (b) Your Content; (c) your breach of these Terms or any representation or warranty made by you herein; (d) your infringement or violation of any third-party rights, including intellectual property rights; or (e) your interactions with other users, including in-person meetings. Bisou reserves the right, at its own expense, to assume exclusive control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with Bisou's defense of such claim.

12. Termination

12.1 Termination by You

You may terminate your account and discontinue your use of the Service at any time by navigating to the account deletion feature in your account settings. Termination of your account does not entitle you to any refund of prepaid subscription fees. Your obligations under these Terms that by their nature should survive termination — including without limitation those relating to intellectual property, disclaimers, limitation of liability, and dispute resolution — will survive termination.

12.2 Termination by Bisou

Bisou reserves the right, in its sole discretion, to suspend or permanently terminate your account and your access to the Service at any time, with or without cause, including for any actual or suspected violation of these Terms; engaging in fraudulent, abusive, or otherwise harmful conduct; extended account inactivity; or where required to do so by applicable law or court order. Where practicable and not prohibited by law, Bisou will endeavor to provide you with thirty (30) days' prior notice of termination without cause. Bisou shall not be liable to you or any third party for any consequences of account termination.

12.3 Effect of Termination

Upon termination of your account for any reason, your license to access and use the Service will immediately cease. Bisou may, in its discretion, delete or retain your account data in accordance with our Privacy Policy and applicable law. Any outstanding fees or payment obligations incurred prior to termination remain due and payable. Provisions of these Terms that by their nature are intended to survive termination shall continue in full force and effect following termination.

13. Dispute Resolution

13.1 Governing Law

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be governed by and construed in accordance with the following laws, depending on your place of residence: United States residents: the laws of the State of Delaware, excluding its conflict of laws principles; Canadian residents: the laws of the province in which you reside; European Union and United Kingdom residents: the laws of your country of residence.

13.2 Binding Arbitration (United States Residents)

For users located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved by informal negotiation shall be submitted to and resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. Arbitration shall be conducted on an individual basis; class actions, class arbitrations, and representative proceedings are not permitted. The following categories of disputes are excluded from arbitration and may be brought in any court of competent jurisdiction: claims that qualify for small claims court (generally under $10,000 USD); claims for intellectual property infringement; and claims for injunctive or other equitable relief to prevent unauthorized use of proprietary information.

You may opt out of the agreement to arbitrate by sending written notice to support@bisoumatch.com within thirty (30) days of first creating your account, stating your name, account email, and your intention to opt out. Opting out does not affect any other provision of these Terms.

13.3 Jurisdiction (Non-United States Residents)

For users located outside the United States, any dispute, claim, or controversy arising out of or in connection with these Terms or the Service that cannot be resolved by negotiation shall be subject to the exclusive jurisdiction of: the courts of your province of residence, for Canadian users; or the courts of your country of residence, for European Union and United Kingdom users.

14. General Provisions

14.1 Changes to These Terms

Bisou reserves the right to amend these Terms at any time. For changes that are non-material in nature, the amended Terms will take effect immediately upon posting. For changes that are material — meaning changes that materially affect your rights or obligations — we will provide you with no less than thirty (30) days' prior written notice, which may be delivered by email to the address associated with your account or by prominent notice within the Service. Your continued use of the Service after the effective date of any amendment constitutes your acceptance of the amended Terms. If you do not agree to the amended Terms, you must stop using the Service and delete your account prior to the effective date.

14.2 Entire Agreement

These Terms, together with the Privacy Policy, Child Safety Policy, and Community Guidelines incorporated herein by reference, constitute the entire agreement between you and Bisou with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to such subject matter.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the validity, legality, and enforceability of the remaining provisions of these Terms shall not in any way be affected or impaired thereby.

14.4 No Waiver

No failure or delay by Bisou in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude the further exercise of that right, power, or remedy or the exercise of any other right, power, or remedy. A waiver of any right, power, or remedy must be in writing signed by an authorized representative of Bisou to be effective.

14.5 Assignment

Bisou may assign or transfer these Terms, in whole or in part, at any time without restriction or notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. You may not assign or transfer these Terms, or any of your rights or obligations hereunder, without Bisou's prior written consent. Any purported assignment by you in violation of this provision shall be null and void.

14.6 Force Majeure

Bisou shall not be in breach of these Terms or otherwise liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, epidemics, power outages, or failures of the internet or third-party telecommunications infrastructure. In the event of such circumstances, Bisou's obligations will be suspended for the duration of the relevant event.

14.7 Language

These Terms have been prepared in the English language. In the event that these Terms are translated into any other language, the English-language version shall govern and control in the event of any inconsistency or conflict between the English version and any translated version.

15. California-Specific Rights

Residents of the State of California may have additional rights and protections with respect to the Service under California law, including rights under California Civil Code Section 1789.3. California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Boulevard, Suite N 112, Sacramento, California 95834, or by telephone at 1-800-952-5210.
